Businesses are in the business of selling products, providing services and, ultimately, making a profit. They are not in the business of litigating. Litigation is time-consuming, stressful and expensive. Smart businesses recognize that pro-actively reviewing and (sometimes) changing certain common business practices is a worthwhile investment to not only prevent disputes from ever materializing into litigation, but also to ensure a position of strength when litigation is unavoidable. In this MB60 presentation, we will present and discuss five simple and relatively inexpensive steps businesses can and should take to avoid litigation where possible and to best protect and position themselves should litigation occur.
